Important Notice|Prohibition of the sale of electronic cigarettes to minors
On June 1, the revised Law of the People’s Republic of China on the Protection of Minors came into effect. The full text of the revised Minor Protection Law has been increased from 72 to 132, a number of legislative provisions have been improved, and clear and specific provisions have been made on many new and complex issues facing the protection of minors. The legal form clearly stipulates that “operators are prohibited from selling cigarettes (including electronic cigarettes) to minors”, and clarifies the social responsibility of protecting minors.

Article 17 The parents or other guardians of minors shall not commit the following acts: (4) indulge or instigate minors to smoke (including electronic cigarettes, the same below), drink alcohol, gamble, wander and beg or bully others; Tobacco, alcohol and lottery sales outlets shall not be set up around schools and kindergartens. The sale of cigarettes, alcohol, lottery tickets or the payment of lottery winnings to minors is prohibited. Tobacco, alcohol and lottery operators should set up signs in prominent positions not to sell tobacco, alcohol or lottery tickets to minors; if it is difficult to tell whether they are minors, they should be required to show their identity documents. No one is allowed to smoke or drink alcohol in schools, kindergartens and other public places where minors are concentrated.
Article 123 If the relevant operators violate the provisions of Article 58, paragraph 1 of Article 59, and Article 60 of this Law, the departments of culture and tourism, market supervision and management, tobacco monopoly, public security, etc. According to the division of responsibilities, order correction within a time limit, give a warning, confiscate illegal gains, and may concurrently impose a fine of not more than 50,000 yuan; if correction is refused or the circumstances are serious, order to suspend business for rectification or revoke business licenses and relevant permits, and may concurrently impose a fine of 50,000 yuan A fine of not less than 500,000 yuan but not more than 500,000 yuan.
Article 124 Whoever violates the provisions of Paragraph 2 of Article 59 of this Law by smoking or drinking in schools, kindergartens and other public places where minors are concentrated shall be punished by the departments of health, education, market supervision and management, etc. According to the division of responsibilities, order corrections, give a warning, and may concurrently impose a fine of not more than 500 yuan; if the site manager fails to stop it in time, the health, education, market supervision and management departments will give a warning according to the division of responsibilities, and impose a fine of not more than 10,000 yuan .
